Privacy Policy for UpHoming
Effective Date: June 24, 2026
1. Introduction
This Privacy Policy explains how Grupo Soluciones Integrales Garcia y Asociados (SIGA) S.R.L. ("we," "our," or "us"), the owner and operator of the UpHoming platform (https://uphoming.com) and its related websites, applications, and data tools (the "Platform"), collects, uses, discloses, and safeguards your information. We are committed to protecting your privacy and building our Platform on a foundation of trust.
Please read this Privacy Policy carefully. By accessing or using the Platform, you agree to the collection and use of information in accordance with this policy and our Terms of Use. If you do not agree, please do not use the Platform.
2. Information We Collect
We collect information you provide directly, information generated through your use of the Platform, and information collected automatically.
A. Information You Provide:
- Account Information: When you create an account, we collect your name and email address, and an encrypted password. If you register or sign in using a third-party provider (such as Google or Facebook), we receive basic profile information from that provider in accordance with your settings there.
- Tool Inputs: When you use our data tools (such as property valuations, due-diligence reports, market intelligence, or the AI-assisted research assistant), we collect the information you submit — for example, property addresses and details, financial figures, search criteria, questionnaire answers, and the prompts or questions you enter ("Inputs").
- Legal Consultation Scheduling: If you choose to schedule a consultation with a vetted legal partner, we collect information necessary to facilitate that appointment, including your name, email, phone number, and any details you provide in a pre-qualification questionnaire (such as budget, property interests, and specific concerns).
- Billing Information: When you purchase a subscription or credits, our third-party payment processor (such as PayPal) collects and processes your payment details. We do not store full payment-card numbers; we receive limited transaction data such as confirmation, amount, plan, and a transaction or order identifier.
- Communications: If you contact us, sign up for a newsletter, or join a waitlist, we may collect your email address, name, company name (for professional waitlists), and the contents of your message.
B. Information Collected Automatically:
- Usage and Device Data: We may collect your IP address, browser type and version, device and operating-system information, the pages and features you use, the Outputs you generate, timestamps, referring URLs, and other diagnostic data.
- Cookies and Analytics: We use cookies and similar technologies to operate the Platform, remember your preferences, maintain sessions, and analyze usage. We may use third-party analytics tools to understand how the Platform is used. You can instruct your browser to refuse cookies or alert you when one is sent, but some features may not function properly without them.
3. How We Use Your Information
We use the information we collect to:
- Provide and Operate the Platform: Create and manage your account, generate valuations, reports, signals, and other Outputs from your Inputs, and deliver the content and updates you request.
- Process Payments: Manage subscriptions, credits, trials, renewals, and related billing through our payment processor.
- Facilitate Legal Connections: Where you request it, use your questionnaire information to schedule a consultation with a vetted legal partner and to allow them to prepare for your meeting.
- Improve and Secure the Platform: Analyze usage, debug, prevent fraud and abuse, enforce our Terms, and improve functionality, accuracy, and user experience.
- Communicate With You: Respond to inquiries, send service and security notices, and (where permitted) send marketing communications you can opt out of at any time.
- Comply With Law: Meet legal, tax, accounting, anti-money-laundering, and regulatory obligations, and protect our rights.
4. Artificial Intelligence and Automated Processing
Some Platform features use artificial intelligence and automated processing, including third-party AI service providers, to generate valuations, estimates, reports, signals, and assistant responses from your Inputs and other data. We choose AI and processing providers that are contractually bound to protect your information and, where applicable, are prohibited from using your personal data or Inputs to train their own general-purpose models.
You acknowledge that AI-generated and automated Outputs are informational aids that may be incomplete or inaccurate, as described in our Terms of Use. We do not use these features to make decisions that produce legal or similarly significant effects about you without an appropriate legal basis and, where required, human review. We describe these technologies generally and do not disclose specific vendors or models for security and competitive reasons.
5. How We Share Your Information
Your trust is our most important asset, and we do not sell your personal information. We share information only in these limited circumstances:
- With Service Providers (Processors): We share information with vendors who help us operate the Platform — such as cloud hosting and database providers, payment processors, email and communications providers, analytics providers, and AI/automation providers — solely to perform services for us and under appropriate confidentiality and data-protection obligations.
- With a Vetted Legal Partner: When you explicitly request a consultation, we share the information you provide (name, contact details, and questionnaire answers) with the designated legal partner for the sole purpose of facilitating that consultation.
- For Legal Reasons: We may disclose information if required by law or in response to valid requests by public authorities (such as a court or government agency), or to protect our rights, users, or the public.
- In a Business Transfer: If we are involved in a merger, acquisition, financing, reorganization, or sale of assets, your information may be transferred as part of that transaction, subject to this Privacy Policy.
- With Your Consent: We may share information for other purposes with your consent or at your direction.
We do not share your Inputs or personal information with Professionals or third parties for their own marketing without your consent.
6. Data Security
We implement administrative, technical, and physical safeguards designed to protect your personal information, including encryption in transit, access controls, and authenticated accounts. However, no method of transmission or storage is 100% secure. While we strive to protect your data, we cannot guarantee its absolute security, and you use the Platform at your own risk as further described in our Terms of Use. You are responsible for keeping your account credentials confidential and for promptly notifying us of any suspected unauthorized access.
7. Data Retention
We retain personal information only for as long as necessary to provide the Platform, fulfill the purposes described in this policy, comply with our legal, tax, and accounting obligations, resolve disputes, and enforce our agreements. When information is no longer needed, we delete or anonymize it. Retention periods vary by the type of data and the purpose for which it was collected; you may request deletion as described in Section 8, subject to legal exceptions.
8. Your Rights and Choices
You have the right to control your personal information:
- Access, Correction, and Deletion: You may contact us to access, update, correct, or request deletion of the information we hold about you, subject to legal exceptions.
- Opt-Out of Marketing: You may opt out of marketing emails at any time using the "unsubscribe" link in those emails; we may still send service or transactional messages.
- Account Settings: You can update certain account information directly in your settings, and you may close your account by contacting us.
- Refusal to Provide Information: You may decline to provide certain information, but this may prevent you from using features that depend on it (such as generating reports or scheduling a consultation).
9. International Users and Regional Rights
Our Platform is operated from the Dominican Republic and may be accessed by users worldwide. By using the Platform, you understand that your information may be processed in the Dominican Republic and other countries that may have different data-protection laws than your own. We rely on appropriate safeguards for international transfers where required.
- Dominican Republic (Law No. 172-13): We process personal data in accordance with applicable Dominican data-protection law, including with respect to the security and confidentiality of personal data.
- European Economic Area & UK (GDPR): If you are in the EEA or UK, you have rights to access, correct, update, delete, restrict, or object to processing of your personal data, and to data portability. Our legal bases for processing include performance of a contract, your consent, our legitimate interests, and compliance with legal obligations. You may also lodge a complaint with your local supervisory authority.
- California (CCPA/CPRA): If you are a California resident, you have the right to know what personal information we collect, use, and disclose, to request access and deletion, to correct inaccurate information, and to opt out of "sales" or "sharing" (we do not sell your personal information). We will not discriminate against you for exercising these rights.
To exercise any of these rights, contact us at the email below. We may need to verify your identity before responding.
10. Third-Party Links and Services
The Platform may contain links to websites or services we do not operate (such as a legal partner's site, payment provider, or third-party resources). We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party sites or services. Your interactions with them are governed by their own terms and privacy policies.
11. Children's Privacy
The Platform is not intended for anyone under the age of 18. We do not knowingly collect personal information from children under 18. If we learn that we have collected such information, we will delete it.
12. Changes to This Privacy Policy
We may update this Privacy Policy from time to time. We will notify you of changes by posting the updated policy on this page and updating the "Effective Date." Material changes may be communicated through additional notice where required. We encourage you to review this policy periodically.
